These Terms of Service ("Terms") govern your access to and use of the NEXUS Audio website, products, and related services (collectively, the "Services"). By placing an order or using our Services, you agree to these Terms. If you do not agree, do not use the Services.
1. About NEXUS Audio
NEXUS Audio designs and distributes premium audio products. Our registered offices are located in Tokyo, Japan and San Francisco, California, United States. Contact us at support@nexusbud.org for questions regarding these Terms.
2. Eligibility
You must be at least 18 years old and able to form a binding contract in your jurisdiction to place an order. By ordering, you represent that the information you provide is accurate and that you are authorized to use any payment method submitted at checkout.
3. Try-before-you-buy program
NEXUS PULSE is offered under a try-before-you-buy model unless otherwise stated at checkout:
- We ship the product to you at no upfront product charge.
- Your payment card is kept on file for authorization purposes.
- If you choose to keep the product within the trial period, you will be charged the keep price displayed at checkout (currently $29.99 USD, subject to change for future orders).
- If you return the product within the trial period in accordance with our Returns Policy, you will not be charged the keep price.
- One unit per customer unless we expressly approve otherwise.
4. Orders and acceptance
Your order constitutes an offer to purchase. We may accept or decline orders at our discretion, including for suspected fraud, inventory limits, shipping restrictions, or errors in pricing or product information. Order confirmation email does not constitute acceptance; acceptance occurs when we ship your order or otherwise confirm fulfillment.
5. Pricing and payment
Prices are shown in U.S. dollars unless noted otherwise. Applicable taxes, duties, and shipping charges may apply based on destination. You authorize us to charge your payment method for amounts due if you keep the product, for replacement fees where applicable, or for other charges described at checkout or in these Terms.
6. Shipping
Estimated shipping timelines are provided for convenience and are not guaranteed. Risk of loss passes to you upon delivery to the carrier. You are responsible for providing a complete and accurate shipping address.
7. Product use and warranty
Products are intended for personal, lawful use only. NEXUS PULSE includes a limited warranty as described on our product pages and support materials. Warranty claims must be submitted to support@nexusbud.org with proof of purchase.
8. Intellectual property
All content on our website and all NEXUS Audio trademarks, logos, product designs, and marketing materials are owned by or licensed to NEXUS Audio. You may not copy, modify, distribute, or reverse engineer our products or materials except as permitted by law.
9. Prohibited conduct
You agree not to:
- Use the Services for unlawful, fraudulent, or abusive purposes;
- Attempt to interfere with website security or order systems;
- Resell trial inventory in violation of program rules;
- Submit false or misleading order or payment information.
10. Limitation of liability
To the fullest extent permitted by law, NEXUS Audio and its affiliates shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Services or any product. Our total liability for any claim relating to an order shall not exceed the amount you paid for that order, or the keep price if no charge has yet occurred.
11. Governing law
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence provide otherwise.
12. Changes
We may update these Terms from time to time. Material changes will be posted on this page with an updated date. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
